Terms of Service

Welcome to Bubby's Kitchen. These Terms of Service ("Terms") govern your access to and use of the Bubby's Kitchen website(s), including bubbyskitchen.org and any associated forms or applications (collectively, the "Site"), and any services offered through the Site, including meal requests, surplus food pickup requests, simcha notifications, refrigerator/drop-off locations, and donations (collectively, the "Services").

By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or Services.

1. About Bubby's Kitchen

Bubby's Kitchen is a 501(c)(3) nonprofit organization (Tax ID: 39-3395919) that rescues surplus food from simchas and events and distributes it to families in need throughout the Five Towns and Far Rockaway community. Our Services include coordinating pickup of surplus food from event venues, distributing meals to families in need, and accepting monetary donations to support our mission.

2. Eligibility

You must be at least 18 years old, or have the involvement of a parent or guardian, to submit a request, donate surplus food, or make a monetary donation through the Site. By using the Site, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. Meal Requests and Pickup Requests

Meal requests and pickup requests submitted through the Site are fulfilled on a best-efforts, volunteer-driven basis. Bubby's Kitchen does not guarantee the availability, timing, quantity, or specific type of food for any request.
Individuals or venues donating surplus food are responsible for ensuring that food is safe, properly handled, and suitable for donation at the time of pickup. Bubby's Kitchen relies on the accuracy of information provided by the donor regarding the food's preparation, handling, and condition.
Bubby's Kitchen and its volunteers make reasonable efforts to handle, transport, and distribute food safely, but cannot guarantee against risks inherent in the handling of prepared or surplus food, including risks arising from the food's condition prior to pickup.
By donating surplus food or requesting meals through the Site, you acknowledge and accept the risks associated with the donation, transport, and consumption of rescued food, and you release Bubby's Kitchen, its officers, volunteers, and affiliates from liability to the fullest extent permitted by law for claims arising from the condition, handling, or consumption of donated food, except where caused by Bubby's Kitchen's gross negligence or willful misconduct.
Bubby's Kitchen operates in a manner consistent with applicable food donation laws, including protections afforded to good-faith food donors and distributors under applicable federal and state law (such as the Bill Emerson Good Samaritan Food Donation Act).

4. Donations

Monetary donations made through the Site are processed by our third-party donation platform, Double Giving. Bubby's Kitchen does not directly collect or store your full payment card information.
All donations are voluntary and, except as required by law or as otherwise stated at the time of donation, are non-refundable.
Bubby's Kitchen is a 501(c)(3) nonprofit organization, and donations may be tax-deductible to the extent permitted by law. You are responsible for consulting your own tax advisor regarding the deductibility of any donation.
Donation receipts, where issued, will be sent to the contact information you provide at the time of donation.

5. Refrigerator / Drop-Off Locations

Venues and organizations that host a Bubby's Kitchen refrigerator or serve as a drop-off/partner location do so on a voluntary basis. Bubby's Kitchen is not responsible for the condition, security, or maintenance of any refrigerator or location beyond its direct control.

6. User Conduct

When using the Site, you agree not to:

Provide false, inaccurate, or misleading information in any request or form;
Use the Site for any unlawful purpose or in violation of these Terms;
Interfere with or disrupt the operation of the Site or servers/networks connected to the Site;
Attempt to gain unauthorized access to any portion of the Site, other accounts, or systems connected to the Site;
Use the Site to transmit any virus, malware, or other harmful code.

7. Third-Party Services

The Site may link to, integrate with, or rely on third-party services, including Double Giving (donation processing), Framer (website hosting), Base44 (web application functionality), and Google services (such as Maps). Your use of these third-party services is subject to their respective terms and privacy policies. Bubby's Kitchen is not responsible for the practices, content, or availability of third-party services.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and the Bubby's Kitchen name and branding, is the property of Bubby's Kitchen or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except as necessary to use the Site for its intended purpose.

9. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BUBBY'S KITCHEN DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY REQUEST WILL BE FULFILLED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BUBBY'S KITCHEN, ITS OFFICERS, VOLUNTEERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES, INCLUDING THE DONATION, HANDLING, TRANSPORT, OR CONSUMPTION OF SURPLUS FOOD, EVEN IF BUBBY'S KITCHEN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BUBBY'S KITCHEN'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless Bubby's Kitchen, its officers, volunteers, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site or Services, your violation of these Terms, or your donation of surplus food.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the Site, you consent to the practices described in our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, practices, or for other operational, legal, or regulatory reasons. Any changes will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

14. Termination

Bubby's Kitchen reserves the right, in its sole discretion, to suspend or terminate your access to the Site or Services at any time, without notice, for conduct that violates these Terms or is otherwise harmful to Bubby's Kitchen, its volunteers, or the community we serve.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of New York.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.
